RETURNS POLICY & WARRANTY
We provide the highest quality products and dispatch orders promptly. If for any reason any item is delivered to a wrong address or arrives in a damaged unusable condition, or if you are dissatisfied with the product you should in the first instance no later than two days following your receipt of the goods Email us detailing fully the problem and provide us with your purchase details, a copy of the receipt and all other relevant information whereupon we warrant and agree that we will deal with such complaint or problem efficiently and expeditiously.
Any refunds agreed upon will be processed expeditiously. Where a refund is agreed you must return the item back to us in the same condition as received in secure packaging within 30 days whereupon you will be provided with a refund or exchange, or a credit in accordance with any written agreement between us.
Upon receiving an order from a customer the item is shipped within 14 days. Any cancellation of any transaction order after 72 hours from receiving the order and receipt of payment will be charged at a 30% rate less shipping fees if they were paid to us.
CARE
We require you observe every possible caution in handling art or memorabilia. All art should be kept away from direct sunlight not washing same in water or using any detergent for cleaning. Simply dust lightly. All memorabilia should be kept safely in a secure space away from bright light and relished in accordance with the love and care you would give to any investment or thing of value.
PACKAGING
Unless otherwise requested Canvas art is back framed and packed with extreme care. Drawings, framed or signed items and memorabilia are always packed with due care and attention for safety and security.
DELIVERY & SHIPPING COSTS
Your order will be processed and delivered to our shippers within 14 days of receiving your order and full payment.
Delivery by shippers usually takes 14-21 days (but may take up to 30 days or more due to holidays, customs checks, etc’) In any event a late delivery caused by any reason beyond our control does not constitute a breach of contract on the part of the website operator or VAN AMSTEL ART & MEMORABILIA and is not an acceptable reason for any orders cancellation by the customer.
All orders are accepted on the clear understanding that the customer acknowledges and accepts they are liable for any and all delivery costs and or ancillary services and or duties or taxes or fees that may apply to the order, including any charges concerning the import storage or customs release of the goods.
PUT IT ON RESERVE ORDER.
The following terms apply to any item sold on reserve order; this is whilst the buyer pays for the goods in four (4) monthly interest-free instalments.
- Record of Payment
A record of payments transaction history will always be available for both the merchant and buyer, recording all amounts paid to-date and the date and value of all future pending payments as per this agreement. - Storage and Identification of Products.
Product’s on reserve will be set aside and stored separately to other products. Products will be clearly identified as ‘Reserve’ products by a title and a number. - Monies Received.
All monies paid by a buyer to the seller for a reserve order will be ring-fenced by the seller and will not be touched until the order is properly delivered to the buyer and the seller has received verification of same by the online tracking system used by the seller’s delivery service. - Cancellation of reserve order by the buyer;
The buyer may cancel their reserve order at any time prior to shipment by advising seller in writing by Email. If a buyer cancels a reserve order seller will give the buyer a “cancellation statement” which sets out-
a) The purchase price of the products; and
b) Advise the buyer of the cancellation fee payable to seller under reserve order terms and conditions; and
c) The total amount paid by the buyer to the date of cancellation and
d) Any amount owing to seller or the buyer under the terms on the cancellation of the reserve order. - Cancellation of reserve order by the Seller.
The seller under a reserve order will not cancel any order unless –
a) The buyer breaches a term of the reserve order; or
b) The seller stops trading; or
c) The products are no longer available
d) For the avoidance of doubt in the event of cancellation by the seller the buyer shall receive a 100% refund of all monies paid. - Cancellation where products are not available
If the products are no longer available, Seller must cancel the reserve order and refund all monies to the buyer. - Effect of Cancellation
Subject to the above, when a reserve order is cancelled by the buyer the seller must refund all money paid within twenty-eight (28) days less a twenty-five per cent (25%) cancellation fee. - Cancellation Charge
For the avoidance of doubt, the seller shall charge the buyer a twenty-five (25%) per cent cancellation fee under the terms of all reserve order deals. - Banking Charges Bank Fees
The seller shall be entitled to pass-on to the buyer all charges received by any given bank for any customer from any reserve order deal. - Reserve Order Reporting
Seller will maintain full reporting for all reserve order deals covering down payments made, the frequency of payments, payments required per instalment and a full record of all payments received up to date (amount and date on which made). - Delivery
The seller will only dispatch (within 14 days) the buyer’s orders after receiving the final instalment payment for all reserve order deals. - MISCELLANEOUS
14.1 This Agreement shall be binding upon, inure to the benefit of, and be enforceable by the representatives, successors and assigns of the parties hereto.
14.2 This Agreement may be amended only by a written instrument duly executed by all parties hereto.
14.3 The parties hereby represent and warrant that each of them has full legal right, power and authority to enter into this Agreement and to carry out its obligations hereunder.
14.4 This Agreement may be executed simultaneously in one or more counterparts, each of which shall be deemed an original but all of which together shall constitute one and the same instrument.
14.5 Article headings contained herein are for reference purposes only and shall not in any way affect the meaning or interpretation of this Agreement.
WEBSITE
We reserve the right to alter or amend this website at our sole discretion including the cancellation changing or editing of terms, text, art, or memorabilia depicted on same and the right to refuse to provide any products to individual or organisation whom we deem untrustworthy.
